Limited Fine Jewelry Warranty
1. Warrantor and Scope
This Limited Warranty is provided by PARANA JEWELS, for new jewelry purchased directly from the Company through www.paranajewels.com from an expressly authorized retailer in the United States.
2. Warranty Period and Eligibility
The Company warrants covered jewelry against verified defects in materials or workmanship for twelve (12) months from the date the item is delivered to the original purchaser.
- Coverage applies only to the original purchaser and is non-transferable, except where applicable law provides otherwise.
- A valid proof of purchase or order number is required.
- Coverage applies only to purchases made directly from the Company or an expressly authorized retailer.
- Items purchased through resale platforms, unauthorized third parties, or whose origin cannot be verified are not covered.
3. What This Warranty Covers
Following inspection, the Company may determine that the following constitute covered manufacturing defects:
- Pre-existing porosity, cracks, or structural defects in the metal.
- Defective soldering attributable to the manufacturing process.
- Clasps, hinges, or closures that fail because of an original manufacturing defect.
- Stones that were loose, materially misaligned, or improperly set at the time of delivery.
- Material differences between the item received and the specifications confirmed in the order.
- Damage existing at delivery and attributable to manufacturing, packaging, or shipping.
Natural characteristics of gemstones and materials—including inclusions and variations in color, veining, texture, shape, size, or tone—are not defects when consistent with the product description, photographs, certification, or reasonable industry tolerances.
4. Available Remedies
If a claim is approved, the Company may, as appropriate and subject to applicable law:
- Repair the item without charge;
- Replace it with the same or a substantially equivalent item; or
- Refund the purchase price actually paid.
Replacement is subject to inventory availability and the unique characteristics of gemstones, precious metals, and custom-made pieces. This warranty does not automatically entitle the customer to a new item or refund when the defect can be adequately repaired, unless applicable law gives the customer the right to choose another remedy.
5. What This Warranty Does Not Cover
This warranty does not cover loss, deterioration, or damage caused in whole or in part by:
- Normal wear and tear, including scratches, dents, marks, loss of polish, minor deformation, or gradual thinning of metals and prongs.
- Impacts, drops, crushing, pressure, snagging, pulling, stretching, twisting, or accidents.
- Wearing jewelry during exercise, manual labor, cleaning, gardening, swimming, bathing, sleeping, or activities inconsistent with the reasonable care of fine jewelry.
- Exposure to chlorine, pools, hot tubs, saltwater, cleaning products, perfume, cosmetics, lotions, hair products, dyes, mercury, sulfur, excessive heat, or other chemicals.
- Cleaning with liquids, products, ultrasonic devices, steam, or methods unsuitable for the applicable metal or gemstones.
- Improper use, care, cleaning, storage, maintenance, packaging, or transportation.
- Warping or deformation of rings, bangles, or open-style jewelry caused by outside pressure.
- Breakage of thin or delicate chains caused by pulling, snagging, stretching, or external force.
- Gradual wear of prongs, clasps, links, settings, plating, finishes, or other components.
- Loss of a gemstone resulting from impact, deformation, worn prongs, accidental damage, or failure to obtain timely maintenance.
- Tarnishing, oxidation, patina, fading, discoloration, or loss of plating caused by the material, ordinary use, body chemistry, or environmental exposure.
- Skin reactions, allergies, or individual sensitivities, unless the product’s materials were inaccurately described.
- Changes in fit resulting from body changes, temperature, pregnancy, medication, or weight fluctuation.
- Failure to follow care or maintenance instructions provided by the Company.
- Negligence, abuse, commercial use, or use for a purpose for which the item was not designed.
- Loss, theft, disappearance, misplacement, or substitution of the item or any gemstone.
- Continued use after the customer discovered, or reasonably should have discovered, a loose stone, worn prong, crack, deformation, or other damage.
- Items expressly sold as used, samples, imperfect, final sale, or ‘as is,’ only to the extent permitted by applicable law.
- Damage caused or aggravated by third-party repairs, resizing, polishing, soldering, stone setting, alteration, or replacement of components.
A repair or alteration performed by a third party will automatically void the entire warranty. Coverage may also be denied when the alteration prevents the Company from reasonably determining the original cause of the problem.
6. Inspection and Coverage Determination
Every claim is subject to a physical or technical inspection. The Company may request photographs, videos, certificates, proof of purchase, maintenance records, repair history, or other information reasonably necessary to evaluate the claim. A missing stone, broken chain, loose clasp, or misshapen item does not, by itself, establish a manufacturing defect.
The coverage determination will be based reasonably on factors including:
- The type and location of the damage and evidence of impact, pressure, wear, misuse, or manipulation.
- The item’s age, reported use, and the condition of its metal, prongs, settings, clasps, and components.
- Its maintenance, repair, and alteration history.
- The results of a technical inspection by the Company or a qualified jeweler, gemologist, or laboratory.
7. How to Submit a Warranty Claim
To submit a claim, the customer must:
- Stop wearing or using the item immediately.
- Contact customers@paranajewels.com during the warranty period.
- Provide the customer’s name, order number, purchase date, and a detailed description of the issue.
- Provide clear photographs of the entire item and the affected area.
- Wait for written return authorization and shipping instructions before sending the item.
Items should not be returned without prior authorization. The Company is not responsible for merchandise sent to an incorrect address or contrary to provided shipping instructions, except where applicable law provides otherwise.
Visible shipping damage should preferably be reported within 48 hours after delivery. The customer should retain all packaging, shipping labels, and photographic evidence. This reporting request helps the Company investigate with the carrier but does not eliminate mandatory rights concerning latent defects or statutory warranties.
8. Shipping, Insurance, and Risk of Loss
When a claim is preliminarily accepted for evaluation, the Company will provide the authorized shipping method and instructions. The customer must package the item securely, follow all transportation and insurance instructions, and avoid indicating on the outside of the package that it contains jewelry.
If a covered defect is confirmed, the Company will pay or reimburse reasonable and authorized expenses necessary to perform the warranty where required by applicable law.
If inspection determines that the condition is not covered, the customer will be informed before paid work is performed. The customer may approve a repair estimate, request return without repair, or decline further service. Inspection, insurance, repair, and shipping charges may be charged for non-covered claims only when disclosed and approved in advance and permitted by law.
9. Non-Warranty Repairs
The Company may offer a repair estimate for a condition that is not covered or arises after the warranty expires. No paid repair will be performed without the customer’s authorization.
Paid repairs are warranted for ninety (90) days against defects in the specific repair work and replacement components, or for any longer period required by applicable law. This repair warranty does not cover unrelated parts of the jewelry or subsequent accidental damage.
10. Custom Jewelry and Customer-Supplied Materials
This warranty does not cover changes in personal preference, incorrect measurements or sizing information supplied by the customer, or features expressly approved by the customer in a custom design.
When a customer supplies a gemstone or other component:
- The Company does not warrant its origin, authenticity, treatment, condition, stability, durability, or value unless expressly agreed in writing.
- Pre-existing inclusions, weaknesses, treatments, chips, fractures, or damage remain the customer’s responsibility.
- Liability for damage occurring during work is not excluded when caused by the Company’s negligence or when applicable law prohibits the exclusion.
11. United States Consumer Rights
This is a Limited Warranty, not a full warranty. It is governed by applicable United States federal law, including the Magnuson-Moss Warranty Act, and applicable state consumer-protection law.
This written warranty does not disclaim, eliminate, or restrict implied warranties or consumer rights that cannot legally be disclaimed, eliminated, or restricted. To the extent permitted by law, any implied warranty, including the implied warranties of merchantability and fitness for a particular purpose, is limited in duration to the duration of this Limited Warranty.
Some states do not allow limitations on how long an implied warranty lasts, so the preceding limitation may not apply to every customer. Customers may have additional rights that vary from state to state.
The Company does not require customers to use paid Company repair services to preserve warranty coverage. However, the Company may deny coverage for damage or failure caused or aggravated by third-party repairs, parts, alterations, resizing, polishing, stone replacement, or other services.
12. Limitation of Liability
To the fullest extent permitted by applicable law, the Company’s responsibility under this Limited Warranty is limited to repair or replacement of the covered item or refund of the purchase price actually paid.
To the fullest extent permitted by applicable law, the Company will not be liable for incidental, indirect, special, punitive, exemplary, or consequential damages, including loss of use, income, profits, opportunity, replacement costs, or sentimental value.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of these limitations may not apply. Nothing in this warranty excludes or limits liability that cannot legally be excluded, including liability arising from fraud, willful misconduct, gross negligence, certain personal injuries, or mandatory consumer-protection rights.
13. Governing Law
Except where applicable consumer law requires otherwise, this Limited Warranty and any dispute arising from it will be governed by the laws of the State of [STATE], without regard to its conflict-of-law principles. Any mandatory rights available under the law applicable to the customer or transaction remain unaffected.
14. Severability
If any provision of this Limited Warranty is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted by law or modified only to the minimum extent necessary. The remaining provisions will continue in full force and effect.
15. Entire Written Warranty
This document constitutes the Company’s complete written warranty for the covered product. No employee, representative, retailer, influencer, contractor, or third party may modify or expand it unless the modification is made in writing and signed by an authorized Company representative.
Company representatives are not authorized to make warranty promises beyond the terms published in this document. Nothing in this section limits an express warranty or other obligation that applicable law determines was created by a product description, advertisement, written communication, sample, or model.
